User Agreement

1. Introduction

Welcome to HeartInCare (“we,” “us,” or “our“). This User Agreement (“Agreement“) governs your access to and use of our platform, including our website (https://www.heartincare.com), Android app, and iOS app (collectively, the “Services“). By accessing or using our Services, you agree to be bound by this Agreement. If you do not agree to these terms, please do not use our Services.

2. About Us

HeartInCare is operated by İNVİCTUS TURİZM KONGRE VE ORGANİZASYON HİZMETLERİ LİMİTED ŞİRKETİ, a company registered in Turkey, with its registered office at Halaskargazi Cad. Teyyareci Cemal Sk.

3. Eligibility

By using our Services, you represent and warrant that you are at least 16 years old and have the legal capacity to enter into this Agreement. Our Services are not intended for individuals under the age of 16.

4. Account Registration

  • Account Creation:
    • To access certain features, you may need to create an account by providing accurate and complete information.
  • Account Security:
    • You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
  • Unauthorized Access:
    • Notify us immediately of any unauthorized use of your account.

5. Use of Services

  • Personal Use: Our Services are provided for your personal, non-commercial use.
  • Health Data Collection: The app collects health data such as heart rate, blood pressure, ECG measurements, steps, sleep patterns, stress levels, and SpO2 levels.
  • Data Accuracy: Data collected by and stored in HealthKit or similar services is for reference only and should not be used for diagnostic or medical purposes.
  • Compliance: You agree to comply with all applicable laws and regulations while using our Services.

6. Termination

  • Termination Rights:
    • HeartInCare reserves the right to terminate or suspend your account if you violate the terms of this User Agreement or engage in activities that may harm the application or its users.
    • This termination is in place to ensure the safety and integrity of the HeartInCare community.

7. User Responsibilities:

  • Accurate Information:
    • You agree to provide accurate and up-to-date information during the registration process and throughout your use of HeartInCare.
    • This ensures that all services provided to you are based on correct and current data.
  • Security:
    • You are responsible for maintaining the confidentiality of your account credentials.
    • Notify us immediately if you suspect any unauthorized access. We are committed to working with you to protect your account.

8. User Obligations

  • Prohibited Activities:
    • You agree not to misuse our Services, including but not limited to:
      • Reverse engineering or decompiling the app.
      • Transmitting viruses or harmful code.
      • Collecting data from other users without consent.
  • Content Responsibility: You are responsible for any content you upload or transmit through the Services.

9. Intellectual Property Rights

  • Ownership:
    • All content, features, and functionality are the exclusive property of HeartInCare and are protected by intellectual property laws.
  • License:
    • We grant you a limited, non-exclusive, non-transferable license to use the Services in accordance with this Agreement.

10. Privacy

11. Modification and Termination

    • You may terminate this Agreement by deleting your account and ceasing all use of the Services.
  • Termination by Us:
    • We may suspend or terminate your access to the Services if you violate any terms of this Agreement.

12. Disclaimer of Warranties

  • As-Is Basis:
    • The Services are provided on an “as is” and “as available” basis.
  • No Medical Advice:
    • The information provided by the Services is for reference only and should not be considered medical advice.
  • No Warranty:
    • We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

13. Indemnification

  • You agree to indemnify and hold harmless HeartInCare and its affiliates from any claims, losses, liabilities, damages, expenses, or costs arising from your use of the Services or violation of this Agreement.

14. Governing Law and Jurisdiction

  • This Agreement shall be governed by and construed in accordance with the laws of Turkey, without regard to its conflict of law principles.
  • Any disputes arising under or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts located in Istanbul.

15. Changes to This Agreement

  • We may revise this Agreement from time to time. Any changes will be effective immediately upon posting.
  • By continuing to use the Services after changes are posted, you agree to be bound by the revised Agreement.

16. Miscellaneous

  • Severability:
    • If any provision of this Agreement is found to be unenforceable, the remaining provisions will remain in full force and effect.
  • Entire Agreement:
    • This Agreement, along with the Privacy Policy, constitutes the entire agreement between you and HeartInCare.
  • Waiver:
    • Our failure to enforce any right or provision of this Agreement will not be considered a waiver of those rights.
